1.PURCHASE CONDITIONS

We invite you to review the general conditions of purchase which regulate the offer and purchase of products from CAFES BALANCILLA, SL through the online shop included in this website.

By using this website you are bound by these conditions and we recommend that you read them carefully. If you do not agree with them, you must quit the website.

1.1 Product information

The descriptions of the products offered on www.cafesbalancilla.es are made on the basis of the information and documentation provided by the suppliers.

The photographs, graphic or iconographic representations and videos relating to the products on www.cafesbalancilla.es, are intended to provide as much information as possible.

In the event that, due to unforeseen circumstances, the product is not available after the purchase has been made, the user will be informed by email about the total or, if applicable, partial cancellation of the order. The partial cancellation of the order does not offer the right to cancel the entire order, without prejudice to the exercise of the right of withdrawal that corresponds to the Partner in accordance with the provisions of these General Conditions.

1.2 Coverage of the offer

The delivery area for these articles is limited to the Iberian Peninsula. By accepting the order, you confirm that you are a customer resident in this area. Any other delivery address will result in the automatic rejection of the order.

1.3 Product prices

The prices of the products offered through the Website include VAT. Prices may be modified at any time. Prices do not include the shipping cost of the products. These are detailed in the payment process, offering the choice of home delivery or shop collection point, having been previously accepted by the user at the time of placing the order.

CAFES BALANCILLA, SL. reserves the right to modify its prices at any time. Products will be invoiced at the stipulated price at the time the order is registered.

1.4 Order confirmation and cancellation

Before you complete your order on the website, you can review all the details associated with your order (amounts broken down under all the necessary headings – taxes, transport costs, item selection, etc), and you can rectify what you think is necessary.

After confirmation, it will not be possible to modify or cancel the order through the website, you must contact cafesbalancilla@cafesbalancilla.es . In this case, the order can only be modified or cancelled if the article has not been dispatched from our premises.

2. SHIPPING FORM

Delivery may be made to the address of your choice (except for PO Boxes). Home delivery of orders will be made by a logistics operator during normal working hours. If no one is at the address when the logistics operator arrives, they will leave a note and their customer service department will try to contact you to arrange delivery.

The delivery charge will be 5.95 euros.

wars, strikes, any form of government intervention, failure of our suppliers, etc. as well as any other attributable to the logistics operator in charge of delivering the product. We are not responsible for any delays that may occur for any of the above-mentioned reasons.

If, at the time of delivery, the packaging of the order is damaged, you must open the package in the presence of the logistics operator to check the condition of the articles. If any damage is observed, you must detail it on the delivery note and contact us. We will repair or replace at no cost to you, all those articles that have been damaged or lost during transport, provided that you notify us of the incident as soon as possible.

Once the order has been delivered, it will become your property and therefore any damage that may occur will be your responsibility.

3. PAYMENT OF THE PRODUCTS

Any order placed must be paid for immediately after confirmation of the order. Orders will only be placed for which payment has been completed and verified.

Payment must be made by credit and debit card (issued by an entity with headquarters in Spain).

The amount of the order will be charged to your card, so you must provide us with the number, expiry date and the CW2 security code (on the back of your card). In the event that your card is secured, you will be asked for the relevant security codes.

These data will not be stored or manipulated by us, but will be directly recorded in the payment gateway procedure of the corresponding financial institution. For greater security, we will use a Secure Electronic Commerce Authentication Service, a system established by Visa / Mastercard / Eurocard, by which the client authenticates himself before his issuing bank and the commerce authenticates itself before its acquiring bank.

The charge will be made in real time through this payment gateway. In the event that the charge cannot be finally carried out (for whatever reason), the order will be automatically cancelled.

4. RETURN OF PRODUCTS

a) Right of withdrawal

The Customer will have a maximum period of 5 calendar days from the delivery of the Product or from the conclusion of the contract in the case of a service, to communicate the total or partial abandonment of the purchase of the Product or service, in accordance with the applicable legislation. The return made within this period shall not entail any penalty. However, the Customer shall be responsible for the shipping costs.

The item(s) must be sent in the original packaging in which they were delivered by the logistics operator.

Once the return has been received by us, we will verify that the items physically returned correspond to the return slip and additionally that they have been received in perfect condition, complete, in their original packaging and with no signs of having been used. If the verification of the state of the order is satisfactory, we will proceed to reimburse the money that you would have paid, in its moment, into the same credit card from which you made the payment, in the maximum period of one month. Otherwise, we will contact you to send you the article again (the transport costs associated with this new shipment will be your responsibility).

b) Return of defective products

The customer shall be entitled to a refund of the price of the defective products or of the products delivered if they do not correspond to the order placed by the customer.

In these cases, the return of the products to www.cafesbalancilla.es must be made by the customer using the following procedure:

Provided that the customer has followed the established procedure and the requirements set out in these General Conditions have been met, the price paid for the returned products that are defective or do not correspond to the order for products made by the customer will be refunded.

c) Guarantee for purchased products

The products have the legal guarantee for lack of conformity from the date of delivery and in accordance with the provisions of the applicable regulations.

To make use of the guarantee, it is essential to keep the proof of purchase and the delivery note of the products.

The customer may exercise the guarantee of a product in accordance with the regulations in force, on the guarantee of consumer products.

5. MODIFICATION OF THE GENERAL CONDITIONS

CAFES BALANCILLA S.L. reserves the right to modify, at any time and without prior notice, the presentation and configuration of , www.cafesbalancilla.es as well as the General Conditions and Privacy Policy. Customers must read these General Conditions carefully each time they access to www.cafesbalancilla.es. In any case, the acceptance of the General Conditions will be a previous and indispensable step to the hiring of any product through www.cafesbalancilla.es

7. APPLICABLE LAW AND JURISDICTION

This site is located and operated in Spain. All matters relating to this site are governed by Spanish law and are subject to the jurisdiction of the competent courts of Spain, without regard to conflict of law principles.

In those cases where the client is not a consumer or user, or is domiciled outside of Spain, he/she will submit to the national Courts and Tribunals, expressly renouncing any other jurisdiction that may correspond to them.

If the user decides to use or consult this site outside of Spain, he/she must bear in mind that he/she does so on his/her own initiative, and that he/she is responsible for compliance with the relevant laws.

This contract will come into force and take full effect from the moment the client or user accepts it.
